While browsing the forum quite often I feel the ongoing Curacao legislation changes floating in the air.


A handful number of players are concerned about the old license's legitimacy while the other part sees many casinos as unlicenced due to the license evolvements.


No wonder though, since the situation is not brightly clear to everyone, me included.

Let's start with the new concept - LOK:


Ministry Silvania said: "We have often been portrayed as a hub for criminal activities and money laundering, contributing to a negative image. However, this perception is set to change with the LOK."


Beyond the AML implications, Silvania acknowledged incorrect reporting regarding the recent issuance of licences. He clarified that the licences were issued under the existing regime – the NOOGH – and not the LOK.


The LOK's foundation was straightforward though:


  • Transition to Direct Licensing and Regulatory Board Reformation: The role of Master Licensees in issuing licenses will cease; the Curaçao Gaming Authority (CGA) will directly issue and oversee licenses instead


  • Rigorous Due Diligence on Online Gambling Entities: The CGA will scrutinize the reputation, business and financial backgrounds of anyone with at least a 10% stake in an applicant company,as well as theirCEOs and key figures


  • Stricter AML/KYC and Responsible Gambling Standards: Curaçao financial intelligence unit and CGA powers will be aligned with the one that their EU and UK counterparties have


  • Legalization of Crypto Payments: This will be a step toward attracting a booming industry of crypto casinos to the Curaçao shores.


Anyway, LOK didn't pass its acceptance, yet remains a highly anticipated promise to the future of Curacao.


The situation now?


For existing sublicensee licensees, preparing for the new regulatory environment is vital to ensure a smooth transition from the Master Licensee era. This includes complex work of auditing internal processes, updating operational policies, engaging reputable testing labs for platform and game certification, and preparing comprehensive KYC/financial documentation for key business figures.


As a result, many casinos prefer not to renew their sub licenses awaiting new forms of licensing systems.

Some others seek temporary licenses easy and affordable to get untill a new system is set up.
