Proverio sam vašu nedavno zatvorenu žalbu. Pa, to zaista zahteva potpuno objašnjenje, pa mi dozvolite da citiram završni rezime:
„Dragi rotarnicolaemihai,
Nakon prikupljanja svih potrebnih informacija i detalja, odlučili smo da ovu žalbu zatvorimo kao neopravdanu. Iako su neki od razloga objašnjeni ranije i više puta, želeo bih da ih sve sumiram i detaljno objasnim.
1 - Registracija iz Holandije
Svaki igrač je dužan da pročita uslove i odredbe pre njihovog prihvatanja. Ovo se radi po registraciji, a vi ste se složili sa njima. Odgovornost igrača je da poznaje zakone u zemlji u kojoj živi. Čak i da je kazino uklonio Holandiju sa liste zemalja nakon zatvaranja vašeg naloga, to bi bilo irelevantno u vezi sa ovim slučajem i povezanim pitanjima. Kao iu svakom drugom kazinu, tu ste mogli da igrate, i imali ste priliku da pobedite kao i svaki drugi igrač, ali ste takođe rizikovali da izgubite. Sredstva su izgubljena igranjem u kazinu. Da ste pobedili, kazino je trebalo da vam isplati vaš dobitak, a mi bismo sigurno bili na vašoj strani. Pored toga, kazino ima pravo da zatvori račun igrača u bilo kom trenutku bez razloga. U tom slučaju, igraču bi trebalo da plati ceo preostali iznos. Pošto je vaše stanje u trenutku zatvaranja računa bilo 0, kazino je postupio ispravno iu okviru svojih uslova i pravila, i mi to prihvatamo.
2 - Nagrada 200 € (keš bonus) sa turnira
Ako sam dobro razumeo odluku kazina, ona nije doneta zbog vaše zemlje prebivališta. Odluka je doneta jer ste je označili kao kršenje zakona u vašoj zemlji od strane kazina, što nije sasvim ispravno, a planirali ste da se obratite nadležnima. Od ovog trenutka pa nadalje, sve što pruža kazino moglo bi se koristiti protiv samog kazina. Druga stvar je što govorimo o bonus novcu. To znači da se uglavnom primenjuju Opšti uslovi bonusa, a kazino ima pravo da vam ga ne pruži po sopstvenom nahođenju.
Ovo je pravilo koje ga navodi direktno u Uslovima i odredbama kazina (dostupno OVDE , OPŠTI BONUS USLOVI - pravilo 1.):
„Zadržavamo pravo da ograničimo igrače iz drugih jurisdikcija da ispunjavaju uslove za bilo koju vrstu bonusa ili na podskup bonusa po našem sopstvenom nahođenju."
Nažalost, ako je kazino odlučio da vam ne dodeli ovu vrstu nagrade, to je u skladu sa njihovim Uslovima i uslovima i mi to prihvatamo.
3 - Istorija igre
Na osnovu gore navedenog, dovoljno smo istražili i razmotrili probleme i ne smatramo potrebnim da tražimo od kazina da pruži kompletnu istoriju za ovu svrhu. After gathering all the necessary information and details, we decided to close this complaint as unjustified. Although some of the reasons were explained earlier and several times, I would like to summarize and explain all of them in detail.
1 - Registration from the Netherlands
Each player is obliged to read the terms and conditions before their acceptance. This is done upon registration, and you agreed with them. It is the player's responsibility to know the law in their country of residence. Even if the casino removed the Netherlands from the countries list after your account closure, it would be irrelevant regarding this case and the related issues. Like in any other casino, you could play there, and you had a chance to win like any other player, but you also risked losing. The funds were lost by playing in the casino. If you had won, the casino should have paid you your winnings, and we would have been on your side for sure. However, if we look at the situation from your sight - it would mean that players registered in this way would never lose anything. They could only win or, in case of loss, get their deposit(s) back. It does not work like that at all. All players who were allowed to play in the casino in this way could only take this opportunity as an advantage, but at the same time take the risk of losing their money - like in any other online casino.
In addition, the casino has the right to close a player's account at any time without a reason. In such a case, it should pay the whole remaining balance to the player. Since your balance at the time of account closure was 0, the casino acted correctly and within its terms and conditions, and we accept it.
2 - Reward €200 (cash bonus) from the tournament
If I understood the casino's decision correctly, it was not made due to your country of residence. The decision was made because you marked it as a violation of the law in your country by the casino, which is not completely correct, and you planned to turn to the authorities. From this point on, anything provided by the casino could be used against the casino itself. Another thing is that we are talking about bonus money. It means that mainly General Bonus terms and conditions apply, and the casino has the right not to provide you with it at its sole discretion.
This is the rule stating it directly in the casino's T&Cs (available HERE, GENERAL BONUS T&Cs - rule 1.):
"We reserve the right to limit players from other jurisdictions from being eligible to any type of bonus or to a subset of bonuses based on our sole discretion."
Unfortunately, if the casino decided not to give you this type of reward, this is in accordance with their T&C and we accept it.
3 - Game history
